2. Platform Nature
Xgreen is an online platform that connects caregivers (who are independent contractors) with families and individuals seeking caregiving services. Xgreen does not provide caregiving services directly, nor is it an employment agency. We function as an intermediary, facilitating the connection, scheduling, and payment processing between clients and caregivers. Xgreen is not a Home Health Agency (HHA), nor do we provide medical or healthcare services.
3. No Medical Services Provided
Xgreen does not provide any medical services or healthcare services, including but not limited to:
• Administration of medications
• Medical treatments or procedures
• Nursing care or physical therapy
Any caregiving services provided through the Platform are non-medical in nature, such as companionship, assistance with daily activities, and personal care. The caregivers you connect with through the Platform are not licensed healthcare providers unless otherwise specified.
4. Independent Contractors
Caregivers using the Platform are independent contractors, not employees of Xgreen. Xgreen is not responsible for the actions, omissions, or performance of caregivers during the provision of services. Clients agree to assume full responsibility for selecting, hiring, and overseeing the caregivers, including determining the scope and nature of the services provided.
5. Limitation of Liability
To the fullest extent permitted by law, Xgreen shall not be liable for any:
• Damages, losses, or injuries arising from or related to the caregiving services provided by caregivers through the Platform.
• Miscommunication or disputes between clients and caregivers.
• Failure of the Platform to deliver the agreed-upon services due to issues outside our control, including but not limited to technical issues or caregiver unavailability.
By using the Platform, you agree that Xgreen will not be held liable for any claims, damages, or losses, whether direct or indirect, arising from the connection with, or use of, the caregiving services provided by caregivers.

Users of the Platform (both clients and caregivers) are solely responsible for:
• Verifying caregiver qualifications: Clients should verify the qualifications and background of caregivers before hiring.
• Ensuring the safety of the services provided: Clients are responsible for ensuring that caregiving services align with their needs and do not involve medical treatment or professional healthcare services.
